Dynamic pricing varies over time; personalized pricing varies by person or group. Surge fares, early-bird rates and clearance markdowns are dynamic. A price that depends on a shopper’s browsing history is personalized.

Why Do Laws Use Different Terms?

Maryland’s HB 895 defines dynamic pricing as a personalized price specific to a consumer based on their personal data, and New York’s § 349-a covers “dynamic pricing set by an algorithm that uses personal data.” The applicable statutory definition takes precedence over everyday terminology.
