Does Pricing by Customer Segment Count as Surveillance Pricing?

It can. Connecticut’s law covers customized prices for “a consumer or group of consumers,” so moving from individual to segment pricing does not by itself take a practice out of scope. What matters is the data behind the segment and how the price is disclosed.

How Does Segment-Based Pricing Help with Compliance?

Segments defined by short, readable rules make it possible to show what data was used, apply the same price to everyone who meets the rule, and publish eligibility criteria, which is what New Jersey’s discount exemption requires.

What Should We Review in Segment-Based Pricing?

  • Whether segment membership relies on sensitive or inferred data
  • Whether any segment pays above the baseline
  • Whether the criteria can be disclosed in plain words
